Summary of the Arizona State Lemon Law

Ariz. Rev. Stat. Ann. § 44-1261

Vehicles Covered: Vehicles under 10,000lbs that are designed primarily for transportation of persons or property. Excludes living or coach portions of motor homes.

Persons Covered: Purchasers, transferees during express warranty period, or any person entitled to enforce the warranty.

Period Covered: Whichever is first: term of express warranty or within 2 years or 24,000 miles following the date of original delivery.

Notice Requirement: (a) Manufacturer – none; (b) Consumer – written notification describing the vehicle and all previous attempts to correct the nonconformity.

Repair Requirements: It is presumed that a reasonable number of attempts have been made if the same nonconformity has been subjected to three or more repairs, or the vehicle is out of service for a cumulative total of 30 or more calendar days.

Affirmative Defenses: The nonconformity does not significantly impair the use, market value or safety of the vehicle, or is the result of abuse, neglect, or any unauthorized modification or alteration by the consumer; statute of limitations.

Replacement/Refund: At the consumer’s option, the manufacturer shall replace with a comparable vehicle, or refund the full purchase price les a reasonable allowance (defined).

Other Reimbursement: Collateral charges, taxes, fees, finance charges and incidental costs.

Arbitration: For remedies under this section, a consumer must use the informal dispute procedure established by the manufacturer, if there is one.
